Governor Newsom signed three e-bike bills on Sept. 30, 2026. None of them changes the city rules above today; the state changes start Jan. 1, 2027.

SB 1167 (Blakespear): e-motos can't be sold as e-bikes

What it does
Keeps the existing e-bike definition (fully operable pedals, motor of 750 watts or less) and makes it illegal to advertise, sell or label mopeds, motor-driven cycles and similar higher-powered devices as e-bikes. E-bike labels must also show the brand and the maker, importer or distributor, and sellers of electric mopeds and e-motorcycles must give buyers a disclosure in their ads, including online. It also bans riding a 2- or 3-wheeled electric device that can go over 20 mph on motor power alone on a public road unless the Vehicle Code defines and allows it there, and lets officers remove one. Crash reports involving these vehicles must record what the label says.
What it means in North County
For parents shopping for a teen: if it can top 20 mph on motor power alone, it is not an e-bike. Starting in 2027, riding one on any Carlsbad, Oceanside, Encinitas, Solana Beach or Del Mar street is banned by state law unless it is a vehicle type the Vehicle Code allows there (such as a registered moped or motorcycle with a licensed rider), and police can remove it.

AB 2346 (Wilson, Berman): trail speed limits, a sidewalk limit, sales disclosures

What it does
Lets a city or county post a speed limit of 15 or 20 mph on bike paths and multiuse trails, or 10 mph in short stretches with heavy foot traffic or poor sight lines, with signs at each end. Sets a 10 mph prima facie speed limit on sidewalks, with no DMV point for a ticket. Requires e-bike sellers to give buyers a written disclosure covering the class, top speed, wattage, age and helmet rules, the CHP safety course link, and a recommendation that riders under 16 stay under 15 mph. Seller fines run up to $500, then $750 and $1,000 for repeats. From Jan. 1, 2029, new e-bikes must come with front and rear lights, and new class 2 e-bikes with a speedometer.
What it means in North County
Any North County city can post 10, 15 or 20 mph limits on its bike paths and trails, but those limits apply only where they are posted. The sidewalk limit does not make sidewalk riding legal where a city bans it, so Solana Beach's sidewalk ban and Del Mar's commercial-sidewalk ban still apply. If you buy an e-bike at a local shop in 2027, expect the written disclosure at checkout.
Effective
Jan. 1, 2027; lights and class 2 speedometers on new e-bikes from Jan. 1, 2029 (Ch. 842, Stats. 2026).

AB 2595 (Papan): an under-12 pilot for San Mateo County

What it does
Creates the San Mateo Electric Bicycle Safety Pilot Program: cities in San Mateo County, and the county in unincorporated areas, may ban riders under 12 from class 1 and 2 e-bikes. It copies the San Diego County model: warnings for the first 60 days, then a $25 fine that is dropped if the rider completes an e-bike safety course within 120 days, with parents jointly liable. The county must report to the Legislature by Jan. 1, 2030, and the pilot ends Jan. 1, 2031.
What it means in North County
Nothing changes here. It applies only in San Mateo County. Carlsbad's under-12 ban comes from the San Diego County pilot (Vehicle Code 21214.7), and San Mateo cities must review the San Diego pilot's report before or after adopting their own ban.
Effective
Jan. 1, 2027, the default start date for 2026 bills; repealed Jan. 1, 2031 (Ch. 843, Stats. 2026).

Carlsbad: under-12 ban, impound, two park bans

What the rule says
Anyone operating an e-bike must be at least 12. A minor's e-bike may be impounded when the minor breaks the rules and creates an immediate or substantial public safety risk. E-bikes are prohibited at Poinsettia and Pine Avenue Community Parks. Riders under 18, and riders of any age on a class 3 e-bike, must wear a helmet. Only e-bikes built for passengers can carry more than one rider.
Who it applies to
Anyone riding in Carlsbad. Parents can be held responsible if they knowingly let their kids break the rules.
What happens if
The laws started March 26, 2026, with a 60-day warning period that ended May 25. Since then riders can be cited or have the bike impounded. To get an impounded bike back, the rider completes a safety course and a test, with a parent or guardian present at release (full steps here).

School district rules: Carlsbad Unified student e-bike permits

What the rule says
Carlsbad Unified's board approved Board Policy 5142.04, "Bicycles and E-bikes," on Sept. 9, 2026. Students in TK-5 and any student under 12 may not bring e-bikes or e-motos to school. Students 12 and older in middle and high school may bring an e-bike only after a district-approved safety course and a district permit sticker. E-motos are banned at every grade, helmets are required, and bikes must be walked on campus.
Who it applies to
CUSD students riding to school or bringing a bike or e-bike onto a CUSD campus. It adds to the city rules above and doesn't replace them.
What happens if
A warning and a call home come first. After that a student can lose riding privileges or the permit, or face school discipline. That includes unsafe riding on the way to or from school (what it means for CUSD parents).

Oceanside: temporary seizure for reckless riding

What the rule says
Police can temporarily seize an e-bike when the rider is cited for reckless operation, failure to exercise due regard for safety, or two or more violations within 12 months. Carrying a passenger is banned unless the e-bike has a passenger seat.
Who it applies to
Riders of any age. Oceanside did not adopt the under-12 ban; police said most of their problem riding involves older teens.
What happens if
Enforcement began Feb. 28, 2026. A seized bike is released to the owner once the case is resolved, with no fines or storage fees. Eligible citations can be cleared by taking a bike or e-bike safety course, and Oceanside Police offer free classes every other month on Saturdays.

Encinitas: impound for reckless riding, more rules under review

What the rule says
City rules already let the San Diego County Sheriff's Office impound e-bikes for reckless operation or unsafe passenger transport. First-time offenders may take an approved safety course instead of paying a fine.
Who it applies to
Anyone riding in Encinitas, including Cardiff, Leucadia and Olivenhain.
What happens if
In August 2026 the council looked at a minimum age of 12, park and sidewalk limits, a nighttime curfew for riders under 16, and dismount rules. Staff are expected back with options, likely in October 2026 (what to watch).

Solana Beach: no sidewalk riding

What the rule says
Municipal Code 10.56.010: "No person shall ride a bicycle upon any sidewalk." Dismount and walk the bike on sidewalks.
Who it applies to
All bike and e-bike riders in Solana Beach. Riders 17 and under must wear helmets, and class 3 e-bike riders must be at least 16 (Vehicle Code 21213).
What happens if
The city lists a $35 fine for sidewalk riding and $25 for a helmet violation, plus court fees on top.

Del Mar: no riding on commercial sidewalks, parks or most lagoon trails

What the rule says
Del Mar's 2025 ordinance (Municipal Code Chapter 14.54) makes it illegal to ride bicycles or e-bikes in parks, in preserves, on sidewalks in commercial areas and on most trails around the San Dieguito Lagoon. Class 1 and 2 e-bikes are allowed on the Coast to Crest Trail segment in Del Mar.
Who it applies to
All bike and e-bike riders in Del Mar.
What happens if
The ordinance was adopted July 7, 2025. Sheriff's deputies can send first-time offenders to a safety training program instead of writing a citation.

State law that applies in every city

Rear red light or reflector, all day (AB 544)

E-bikes must show a rear red reflector, or a solid or flashing red light with a built-in reflector, at all hours instead of only after dark. AB 544 was signed July 14, 2025. It also lets proof of a specialized e-bike safety course, including the CHP's program, get certain e-bike fines dismissed.

Certified batteries and chargers (SB 1271)

Starting Jan. 1, 2026, e-bikes and their batteries and chargers sold or leased in California must be certified by an accredited testing lab to standards like UL 2849 or EN 15194. Rentals have until Jan. 1, 2028. This rule falls on sellers, not riders; secondhand items are exempt from the labeling requirement.

The under-12 pilot (Vehicle Code 21214.7)

Cities in San Diego County, and the county in unincorporated areas, may ban riders under 12 from class 1 and 2 e-bikes. Violators get a warning for the first 60 days, then a $25 fine that can be waived after an e-bike safety course. Parents share liability. The pilot ends Jan. 1, 2029 unless extended.

Can a 12-year-old ride an e-bike in Carlsbad?

Yes. Carlsbad requires anyone operating an e-bike to be at least 12, so an 11-year-old cannot ride one there but a 12-year-old can. Riders under 18 must wear a helmet. Source: City of Carlsbad, laws in effect since March 26, 2026.

Does Oceanside ban kids under 12 from e-bikes?

No. As of its 2026 ordinance, Oceanside did not adopt the under-12 ban. Instead police can temporarily seize e-bikes for reckless riding or repeat violations, and a seized bike is released after the case is resolved, with no fines or storage fees.

Can I ride my e-bike on the sidewalk in Solana Beach or Del Mar?

Not in Solana Beach, where the municipal code bans riding bicycles on any sidewalk. In Del Mar, riding is banned on sidewalks in commercial areas, in parks and preserves, and on most San Dieguito Lagoon trails. Walk the bike instead.

Do e-bikes need a rear light during the day in California?

Yes. Since AB 544, an e-bike needs a rear red reflector, or a solid or flashing red light with a built-in reflector, at all hours, not just after dark.

What e-bike laws did Governor Newsom sign on Sept. 30, 2026?
