Mobile home space rent going up in Encinitas? What to do

The 90-day rule, what the state cap covers, what the City is doing, and who helps for free.

The short answer: if you own your mobile home and rent the space in an Encinitas park, there is no local limit on space rent yet, and California's 5% cap covers only parks that sit inside two or more cities. What does apply: the park must give you written notice at least 90 days before any increase. The City Council took up an emergency ordinance at its October 28 meeting (Item 12B); check the City's meeting page below for what it decided.

What the Council took up on October 28

Item 12B on the Wednesday, October 28, 6pm agenda: "Adoption of an Urgency Ordinance and Introduction of a Non-Urgency Ordinance Establishing a Temporary Moratorium on Mobile Home Space Rent With a Cap on Space Rent Increases." What the staff report proposes:

  • The cap: no space rent increase above the amount in effect on October 28, 2026, except up to the lesser of 4% or 75% of the Consumer Price Index rise (San Diego-Chula Vista-Carlsbad) over the prior 12 months. If prices fell, no increase.
  • No workarounds: no new or higher fees in place of rent, no cutting services without lowering rent, no retaliating against residents who use the ordinance. Increases that break it would be void, with extra rent refunded or credited.
  • When: the urgency version takes effect immediately if 4 of the 5 Council members vote yes; the regular version takes over 30 days after adoption. It ends July 30, 2027, or when a permanent rent program starts, unless extended.
  • Owners: a park owner who says the cap blocks a fair return can petition the City Clerk for a public hearing.
  • Who it covers: the City counts 11 mobile home parks with about 729 spaces.

How to weigh in: email cityclerk@encinitasca.gov with the agenda item in the subject line; in person at City Council Chambers, 505 South Vulcan Avenue (speaker requests open 30 minutes before 6pm, 3 minutes each); or by phone: register first at publiccomment.encinitasca.gov, then call +1 760-334-5039 and enter meeting code 1186.

From the City's October 28 agenda and the Item 12B staff report, read October 21, 2026. It is a proposal until the Council votes. Not legal advice: for your situation, the free legal aid lines below.

Check your notice: the 90-day rule

California's Mobilehome Residency Law: "The management shall give a homeowner written notice of any increase in his or her rent at least 90 days before the date of the increase." (Civil Code 798.30.) A notice by email counts only if you gave the park written consent to email you.

Pick both dates to count the days.

Keep the notice and the envelope. The State asks for proof you own the home and the park's name, address and phone when you file.

Does California's rent cap cover my park?

  • The cap: no more than "3 percent plus the percentage change in the cost of living, or 5 percent, whichever is lower" in 12 months (Civil Code 798.30.5).
  • The catch: it covers only a "qualified mobilehome park," one "located within and governed by the jurisdictions of two or more incorporated cities." A park inside Encinitas alone isn't one.
  • Not covered either: deed-restricted affordable spaces, resident-owned parks, and spaces under a stricter local ordinance. When a new owner moves in, the park can set the starting rent.
  • It ends: the section is repealed January 1, 2030, unless lawmakers extend it.
  • Newer parks: new construction is exempt from local rent ordinances for 15 years (Civil Code 798.45).

What Encinitas is doing

  • No local law yet: "in Encinitas, there's no law protecting mobile homeowners from rent increases" (inewsource, Oct 16).
  • October 14: the Council "voted unanimously to direct staff to draft an emergency ordinance" on mobile home park rent, plus a long-term rent stabilization ordinance and a local review board. It also asked whether an agreement between park owners and residents might work better.
  • October 28: the proposal goes on the Council's October 28 agenda (San Diego Union-Tribune, Oct 19). See the City's meeting page for the outcome.
  • The notices: Encinitas has 11 manufactured home parks where residents own the homes and rent the land. One resident was told 12.5%, about $350 more a month, starting November; others got 17%. At Riviera on Vulcan Avenue, the park later moved to a 4% increase.
  • Nearby: Oceanside has an 8% cap, and Chula Vista, Escondido and Imperial Beach have protections too (CBS 8).

Questions people ask

How much can my mobile home park raise my space rent in California?

Unless your park sits inside two or more cities or your city has its own ordinance, state law sets no percentage limit. The cap of 3% plus inflation, 5% at most, in Civil Code 798.30.5 covers only those two-city parks, and Encinitas has no local ordinance yet.

How much notice does a mobile home park have to give before raising space rent?

At least 90 days, in writing (Civil Code 798.30). Email counts only if you gave written consent. Short or missing notice is a complaint the State's Mobilehome Assistance Center takes at (800) 952-8356.

Is Encinitas freezing mobile home space rents?

The Council took up an emergency ordinance on October 28; the City's meeting page has the outcome.
