Get your security deposit back in California

The 21-day rule, what a landlord can deduct, the pre-inspection, and the letter and small claims steps, in the California Courts' own words. When it's messy SideGuy is there!

Short answer: in California the landlord has 21 days after you move out to return the whole deposit, or return it minus deductions with an itemized statement, with receipts for deductions over $125. If it doesn't come back, write the landlord a letter, then small claims court, where a judge can add up to twice the deposit when it was kept in bad faith. PJ, a local in Cardiff, helps with the paperwork: the move-out photos, the letter and the small claims forms, $30 an hour.

The 21-day rule

The California Courts' guide: "After a tenant moves out, a landlord has 21 days to either Return all of the security deposit Return the security deposit minus any deductions along with an itemized statement." "The itemized statement must list what was deducted and why. If the deductions are for more than $125.00, the landlord must attach a copy of any invoices or receipts with the itemized statement." If repairs take longer for a good reason, the landlord can send "a reasonable (good faith) estimate" and then the receipts "within 14 days of the repairs being done" (California Courts).

What a landlord can deduct

  • Cleaning, "but only to make it as clean as when the tenant first moved in."
  • Damage "other than normal wear and tear, caused by the tenant and the tenant's guests."
  • Furniture or other items, "but only if this was included in the rental agreement and the damage isn't from normal wear and tear."
  • Rent owed, generally, with exceptions, such as ending a lease early because of violence (Civil Code 1946.7).

Before you move out: ask for the pre-inspection

"After the tenant gives notice, the landlord must tell the tenant in writing that they have the right to ask for a pre-inspection. This gives the tenant a chance to repair things before moving out so they get their security deposit back" (California Courts). Take dated photos of every room the day you hand back the keys.

If the deposit doesn't come back

  1. Write the landlord a letter asking for it back, and "keep a copy of the letter for their records."
  2. Small claims court. A tenant can sue for "The amount of the deposit" and "Two times the amount of the security deposit in damages," which "The judge may give the tenant" if the landlord kept it in bad faith. "A person who's a tenant can only sue for up to $12,500 in small claims court" (California Courts).
