How to cancel and get your money back in California

The 3-day right to cancel, 5 days at 65 or older, contractors, subscriptions that renew and the 60-day credit card letter, in the rules' own words. When it's messy SideGuy is there!

Short answer: most things bought at home from a salesperson come with 3 days to cancel, and in California a buyer 65 or older gets 5 days on home solicitation, home improvement, PACE, service and repair, and seminar sales contracts. Cancel in writing before the deadline. Subscriptions that renew must give you an easy way out, and a wrong credit card charge has a 60-day letter window. PJ, a local in Cardiff, can write the letter and get it out the door with proof: $30 an hour.

Bought at home: 3 days, 5 at 65 or older

The federal Cooling-Off Rule covers sales of "a purchase price of $25 or more if the sale is made at the buyer's residence or a purchase price of $130 or more if the sale is made at locations other than the buyer's residence," like hotel rooms, convention centers, fairgrounds and restaurants. The seller has to tell you, in these words: "You, the buyer, may cancel this transaction at any time prior to midnight of the third business day after the date of this transaction" (16 CFR 429).

California adds two days for older buyers. The Contractors State License Board says "seniors (those 65 and older) will have five days to cancel the following transactions: home solicitation contracts, home improvement contracts, Property Assessed Clean Energy assessment contracts, service and repair contracts, and seminar sales contracts (AB 2471)" (CSLB).

Contractors and home improvement

The board says: "Unless the contract is negotiated at the contractor's place of business, and/or the contract price is under $25, the buyer qualifies for a three-day right to cancel," and five days at 65 or older (CSLB). How to cancel, and when the money comes back

In writing, before the deadline. The federal cancellation notice reads: "To cancel this transaction, mail or deliver a signed and dated copy of this Cancellation Notice or any other written notice." Then the seller has to "within 10 business days after the receipt of such notice" "Refund all payments made under the contract or sale" (16 CFR 429).

  • Keep a copy of the signed contract and the letter.
  • Send it a way you can prove: certified mail, or hand delivery with a dated receipt.
  • Count business days, not calendar days, from the day of the sale.

A store that won't take it back

The California Attorney General says retailers that won't give a full refund, credit or equal exchange within seven days of purchase, with a receipt, "must clearly display their policy at each cash register and sales counter, or at each public entrance, or on tags attached to each item sold under the policy, or on the retail seller's order forms." And: "If a store violates this law (California Civil Code section 1723) by not clearly displaying their limited or no return policy, you can return the purchased item with proof of purchase for a full refund within 30 days." Exceptions include perishable items, final-sale items and custom orders (California Attorney General).

Subscriptions that renew

California's Automatic Renewal Law "was recently amended, effective July 1, 2025, to make it stronger." The Attorney General says businesses "must give consumers a clear and straightforward method for cancelling unwanted subscriptions," and "If a consumer enrolled in an auto-renewal or continuous-service plan online, they must be able to cancel it online at will" (California Attorney General). If a business won't let go, the AG takes complaints at oag.ca.gov/report.

A wrong charge on the credit card: the 60-day letter

For a billing error, the written notice has to reach the card company "no later than 60 days after the creditor transmitted the first periodic statement that reflects the alleged billing error" (Regulation Z, 12 CFR 1026.13). Send it to the billing-error address printed on the statement, not the payment address. Paid with Zelle or Venmo instead? Different rules: Zelle and Venmo help.
